Procedures for Signing a Contract

Procedures for signing contracts will vary from region to region, from school to school, and according to the prospective employee’s nationality, current legal status and other personal circumstances.

However, some or all of the steps below are quite common when EU nationals sign a contract with a language school in Spain.

  • The employer makes a formal offer of employment to the candidate.
  • The candidate verbally accepts the formal offer of employment in accordance with the conditions outlined.
  • The employer issues a Pre-Contractual Agreement in the candidate’s name.
  • The candidate signs the Pre-Contractual Agreement.
  • The employer signs the Pre-Contractual Agreement.
  • The candidate registers as a foreign national in the Register of Foreign Nationals (Registro Central de Extranjeros) at the Central Police Headquarters (Dirección General de la Policía y de la Guardia Civil) in the province where he/she is going to live.
  • The candidate is issued with an identity number or NIE (Numero de Identidad de Extranjero) and a certificate stating that he/she has been registered in the Register of Foreign Nationals (Registro Central de Extranjeros).
  • The candidate applies for a Social Security number at the Department of Social Security and is issued with one.
  • A draft contract with the candidate’s details is completed at INEM (the National Employment Institute in Spain). This draft contract is then signed by the candidate and the employer.
  • INEM approves the draft contract and the contract becomes a valid legal document binding the employer and employee to the conditions stipulated in it.
